In accordance with Law 20/2014, of 16 October, regulating electronic contracting and operators that conduct their economic activity in a digital space, we hereby inform you that you have accessed a website (hereinafter, “the Website”) whose domain name (www.andorra-digital.com) is owned by Unitat de Direcció Andorra Digital de la Fundació Privada del Sector Públic Andorra Recerca i Innovació (hereinafter, “Andorra Digital”), created and governed in accordance with Law 11/2021, of 13 May, on the creation of the Fundació Privada del Sector Públic Andorra Recerca i Innovació, and the agreements of the Board of Trustees of this foundation, registered in the Register of Foundations of the Government Ministry of the Interior under number 8/2021 - registered on 19 October 2021-, address Avinguda Rocafort, 21-23, El Molí Building, 3a planta, in Sant Julià de Lòria (Principat d’Andorra), and holder of Tax Registrastion Number U-380100-T.
The purpose of the website is to provide information with regard to, the activities, projects, programmes and other Andorra Digital initiatives (hereinafter jointly, referred to as, “the initiatives”).

Accessing the Website implies full acceptance, by the users thereof, of these terms and conditions of use, as well as the privacy policy and the “cookies” policy, all of which are also available on the Website (hereinafter jointly, referred to as, “the Terms and Conditions”).
Likewise, Website users hereby undertake to make diligent use thereof and of the contents contained therein, in accordance with current legislation, as well as in good faith, and without contravening the principles of public order and morality.
Therefore, among others, accessing the Website or using it for illegal purposes is strictly prohibited, and the following is therefore, by way of example and without limitation, strictly prohibited:
Andorra Digital reserves the right to carry out, without prior notification, at any time and with immediate effect, any modifications and periodic updates to the Terms and Conditions that it deems to be appropriate. Therefore, Andorra Digital urges Website users to regularly review the Terms and Conditions.
For the purposes of the Terms and Conditions, the term “content” shall refer to all the content published on the Website, which shall be understood to be, by way of example and without limitation, the source code, the Website design and information architecture, as well as the distinctive signs, videos, photographs, illustrations, graphics, texts, data and other information displayed.
The contents are subject to intellectual property rights, industrial property rights, image rights and/or other legal rights of similar economic content owned by Andorra Digital or by third parties who have granted the applicable licences or authorisations. Therefore, access to the Website shall in no case grant users any ownership or right of use over the content (through, among others, the reproduction, distribution, public dissemination, making available or transformation), unless Andorra Digital or the third-party holders of the legal rights in question authorise them to do so either by expressly indicating this on the Website or by obtaining licences or authorisations in writing to this effect.
Therefore, Andorra Digital reserves the right to use watermarks, technological devices or other security measures to track or monitor unauthorised uses of the content. And, in any case, Andorra Digital reserves the right to take civil or criminal legal action against users of the Website who infringe intellectual property rights, industrial property rights, image rights or other legal rights of an economic nature that the content is subject to.
Should a user deem that any of the content violates the legal rights of third parties, they must notify Andorra Digital forthwith via the contact or complaint channels indicated in the section “Ownership and purpose of the Website”, with a view to the business analysing and assessing on a case-by-case basis.
Andorra Digital reserves the right to refuse or suspend, without prior notice and at their discretion, at any time and on a definitive or temporary basis, access to the Website for users who fail to comply with the Terms and Conditions. Andorra Digital’s right in this regard is without prejudice to any civil or criminal legal action that it may take against any users found to be in breach thereof.
Users shall be solely responsible for taking all the appropriate measures to protect the devices and associated software they use to access the Website from, among others, viruses, malicious code or other harmful programmes or files.
Users shall be solely responsible for how they use the Website content.
Should users make enquiries or file a complaint before Andorra Digital through the channels indicated in section “Ownership and purpose of the Website”, they shall be held liable for any damage or harm caused to the business or to third parties as a result of providing false or inaccurate data or information.
Users shall also be held liable in all other cases in which the Terms and Conditions are not complied with, such as, but not limited to, in the cases set out in the section “Acceptance of the Website Terms and Conditions of Use”.
Andorra Digital shall be held harmless vis-à-vis any damages or other consequences arising from the way users use the Website or the contents contained therein.
Andorra Digital shall be held harmless vis-à-vis any damages or other consequences arising from the unavailability of the Website or its contents on grounds of a technical, security, control, update or maintenance nature, or due to errors caused by servers or third-party intermediaries or providers, such as telephone line outages or system overloads.
Andorra Digital shall be held harmless vis-à-vis any damage or harm caused to users of the Website by malicious software, the actions of cybercriminals or other unlawful interference by third parties.
Andorra Digital has no control over the services, content and/or other elements that Website users may access through the technical devices vis-à-vis links, directories or others that may be accessed via the Website (such as Facebook, Instagram, Twitter, LinkedIn and similar). Therefore, Andorra Digital shall not be held responsible for the technical availability, the quality or the accuracy, among others, of the services, content and/or other elements that have been accessed, nor for any damage or harm or other consequences that may arise as a result of the use thereof. In no case, shall the aforementioned accesses supersede any agreements entered into with the owners or people responsible for the services, content or other elements involved, nor recommend, promote or identify Andorra Digital therewith.
Users who visit and/or use any of the third party links, do so at their own risk, and must take the appropriate protective measures.
Notwithstanding the foregoing, should users deem that via any of the technical devices, directories or other methods to which access can be gained via the Website, the rights of third parties have been violated, they must notify Andorra Digital forthwith via the contact or complaint channels indicated in the section “Ownership and purpose of the Website”, with a view to the business analysing and assessing on a case-by-case basis.
Andorra Digital may, temporarily or definitively, suspend access to the Website, in the event that it is unable to do so or simply does not wish to continue the operation thereof; in these cases, user access shall be suspended forthwith with Andorra Digital being held harmless in this regard.
Likewise, Andorra Digital reserves the right, at any time and without having to notify users in advance, to modify any Website content, or to update or correct errors or inaccuracies, without users being able to hold them liable.
Provided that it does not contravene the stipulations set forth in the legislation in force, in the event that, further down the line, Andorra Digital is held liable for damages to Website users, the business’s liability shall be limited to, actual and specific damages.
Notwithstanding the foregoing, Andorra Digital shall not be held liable in any case whatsoever vis-à-vis damages or other consequences arising from users not complying with the Terms and Conditions.
Any third-party link to the Website, shall not imply an unfair use of the contents thereof, unless the third parties in question have obtained prior written authorisation from Andorra Digital.
Likewise, Andorra Digital strictly prohibits providing links to the Website from other websites with content that is contrary to the law, good faith, good conduct, public morality and order.
In no case, shall third-party links supersede the existence of agreements with the owners or those responsible therefor, nor recommend, promote or identify Andorra Digital with the declarations, content, goods or services offered. Users who visit and/or use any of the aforementioned third-party links, do so at their own risk, and must take the appropriate protective measures.
The Terms and Conditions are governed by the laws of Andorra.
Website users are subject to Andorran jurisdiction, expressly waiving any, other rights that may, correspond thereto in accordance with the law.
The foregoing is without prejudice to the fact that, due to a user’s status as a consumer, other legislation and/or jurisdiction may be applicable by law.
