The purpose of this Privacy Policy is to govern and provide information vis-à-vis how THE FOUNDATION processes and uses the personal data obtained in the course of its professional activity.

Furthermore, this Privacy Policy is consistent with the Privacy Policy of www.andorra-digital.com and, broadly speaking, with all possible projects and/or companies that report to the FOUNDATION and/or that may be linked thereto, which, expressly refer to this document, without prejudice to the Conditions of Particular Applications set forth therein.

This Privacy Policy has been drawn up in accordance with the national and international legislation applicable in this field, and, more specifically: 

  • Law 29/2021, of 28 October, on personal data protection), and the regulations that develop it (hereinafter jointly, referred to as, “LQPD”).

THE FOUNDATION hereby ensures that all data processing complies with the requirements set forth in the LQPD; The FOUNDATION shall adopt the technical and organisational measures necessary to guarantee the confidentiality and security of the personal data processed, and therefore guarantees that any personal data processed shall be subject to the utmost professional secrecy. These measures shall be adopted with a view to preventing the alteration, misuse, loss, theft, and unauthorised processing of and/or access to personal data.

Furthermore, THE FOUNDATION hereby notifies that the personal data and other information you provide must be truthful and accurate. In any case, the user shall be responsible for the truthfulness and accuracy of the aforementioned data and information, and THE FOUNDATION may, in any case, exclude him/her from its contacts should the user have provided false or inaccurate data or information, without prejudice to any legal action that may correspond thereto.

Furthermore, in accordance with the LQPD, THE FOUNDATION hereby informs that data subjects may exercise their rights of access, rectification, deletion, limitation of processing, opposition and portability of data."

 

3. WHAT DATA DO WE COLLECT?

Any person that uses the Website and/or APP is conferred the status of user (hereinafter, the ”User).

Visiting this Website does not imply that the User provides personal data. Any data provided by Users may be processed by THE FOUNDATION as the Data Controller, and shall be retained and processed in Andorran territory at all times.

By providing us with your details, you thereby guarantee that they are accurate and complete. Furthermore, you hereby confirm that you are responsible vis-à-vis the veracity of the personal data provided and that they shall be duly updated so that they reflect the true situation thereof, being responsible for any false or inaccurate personal data that may be provided, as well as for any, direct or indirect damage, or harm that may arise from the inaccuracy thereof.

You may not provide personal data belonging to other people unless it is justified vis-à-vis the services you are requesting. In any case, if you provide us with the personal data of third parties, you hereby assume the responsibility of informing these third parties prior to providing us with their personal data. This information to be provided to third parties, must include all the provisions set forth herein, and you shall be responsible vis-à-vis the legality of these personal data and for conveying the rights the data subjects may exercise vis-à-vis their personal data.

4. Participation in events organised by Andorra Digital. We collect and process the personal data of natural persons who apply to take part in the event on their own behalf or on behalf of a business.

6. DATA RETENTION PERIOD

Your data shall be retained for a period depending on the purposes for which they are processed, as follows:

We shall process your personal data for as long as it is necessary to completely execute the “Business Digitalisation Programme” (PDE) and other actions associated therewith.

4. Participation in events organised by Andorra Digital.

We shall process your personal data for as long as it is necessary to carry out the event in its entirety and other actions associated therewith.

Regardless of fact that we process your data for the time strictly necessary to comply with the corresponding purpose, we shall subsequently safeguard and protect them during the time in which liabilities deriving therefrom could arise, in accordance with the regulations in force at any given time. We shall delete the personal data, once the possible actions in each case have expired.

 

7. EXERCISING YOUR RIGHTS

THE FOUNDATION hereby informs Users that they can exercise the following rights pursuant to the applicable regulations:

a) The right of access to their personal data with a view to ascertaining what data is being processed and the purposes and methods of the processing activities carried out thereon.

b) The right to rectify any inaccurate or incomplete personal data.

c) The right to delete their personal data, unless there is a legal obligation to retain them and/or there are no other legitimate reasons for them to be processed by THE FOUNDATION.

d) The right to request the limitation of the processing of their personal data, meaning that, in certain cases, we may be asked to temporarily suspend the processing of personal data or to retain them for longer than necessary."

e) When the processing of data is based on our legitimate interest or on a public interest, data subjects shall also have the right to oppose the processing of their data.

f) When the processing of data is based on giving consent, data subjects shall have the right to withdraw this consent at any time, without this withdrawal affecting the processing that has already been legitimately carried out hitherto.

g) And, furthermore, when the processing of data is based on a data subject’s consent, or, if need be, to execute a contract they have entered into, data subjects shall have the right to the portability of their personal data.

With a view to fulfilling the purposes set forth in this Privacy Policy, we need to give THE FOUNDATION’s staff access to your personal data as well as to service providers and third parties that support the services, we offer you:

  • Drivers and collaborators of the “Digital Business Programme” (PDE, as per its initials in Catalan), including the Ministry of the Interior of the Government of Andorra, Andorra Development and Investment, SAU and the Chamber of Commerce, Andorra Industry and Services, SAU.

In any case, we hereby inform you that your data shall be processed with the utmost guarantees and shall be safeguarded at all times.

 

9. MODIFICATION OF THE PRIVACY POLICY

THE FOUNDATION reserves the right to modify this Privacy Policy with a view to bringing it into line with future legislative or jurisprudential developments, as well as with future uses that may be made of the personal data of the Website and APP users.

Should we do so, if the change affects you, we shall notify you through different channels, for example by e-mail. In any case, we recommend reviewing this Privacy Policy every now and then in case any minor changes or interactive improvements have been made thereto, as this will always be listed as a point of information on our Website and APP.
